1 Introduction and Acceptance

These Terms of Service ("Terms") govern the use of the website cncsimulatoritalia.it and the services offered by CNC Simulator ITALIA di Benedetto Antonio.

By accessing the website or using our services, you acknowledge that you have read, understood, and fully accepted these Terms. If you do not agree, please do not use the website or our services.

2 Definitions

• "Website": the company's websites and all their pages
• "Services": software, licenses, technical support, and any other services offered
• "User": any natural or legal person who accesses the Site
• "Customer": A user who makes a purchase or signs up for a subscription
• "License": the right to use the software granted to the Customer
• "Lifetime License": a right of use granted without a time limit, valid for the entire commercial life of the product
• "Maintenance Period": the annual period during which the Customer is entitled to Updates and Technical Support
• "Maintenance Update": bug fixes, security patches, and compatibility updates (e.g., new operating systems) intended to ensure that the originally purchased version remains fully operational. Evolutionary Updates (new features introduced after purchase) are excluded.
• "Commercial Life of the Product": the period during which CNC Simulator ITALIA, owned by Benedetto Antonio, continues to market and develop the software. The Lifetime License refers to the commercial life of the product and does not constitute a guarantee of the company's unlimited duration or the perpetual provision of updates and support.
• "Content": text, images, software, code, and any other material on the Site

3 Description of Services

CNC Simulator ITALIA di Benedetto Antonio offers the following services:

4 Registration and Account

To access certain services, you must create an account. You agree to:

• Provide truthful, accurate, and complete information
• Keep your information up to date
• Keep your login credentials confidential
• Report any unauthorized access immediately
• Do not create multiple accounts or accounts using false identities

We reserve the right to suspend or terminate accounts that violate these Terms.

Age Requirements

The Services are intended for individuals who are at least 18 years of age. Individuals under the age of 18 may register and make purchases only with the prior consent and under the supervision of a parent or guardian, who assumes all obligations arising from the contract, including payment. By placing an order, the User declares that they have the legal capacity required by law or that they are acting with the consent of the person exercising parental responsibility.

Providing a tax identification number, which is required for issuing an invoice, does not in itself constitute proof of legal age: in Italy, a tax identification number is assigned at birth.

If it is determined that an account is registered in the name of a minor without the required consent, we reserve the right to suspend the account and cancel any related orders, refunding any amounts paid.

5 Software Licenses

5.1 Grant of License

Upon purchase, the Customer receives a non-exclusive, non-transferable license to use the software, in accordance with the specific terms of the license type purchased.

5.2 Restrictions

The Customer may NOT:

• Copy, modify, decompile, or disassemble the software
• Resell, transfer, or sublicense the software to third parties
• Remove copyright or intellectual property notices
• Using the software for illegal purposes
• Sharing license credentials with unauthorized third parties

6 Purchases and Payments

6.1 Prices

Prices are listed in euros. CNC Simulator ITALIA, owned by Benedetto Antonio, operates under the flat-rate tax regime (Art. 1, paragraphs 54–89, Law 190/2014): transactions are not subject to VAT. We reserve the right to apply VAT in the event of future changes to the tax regime, without retroactive effect on orders that have already been confirmed. 6.2 Payment Methods

We accept the following payment methods:

• Credit/Debit Card
• Bank transfer
• PayPal (where available)

6.3 Billing

For every order with an amount greater than zero, an electronic invoice is issued in accordance with current Italian law, transmitted via the Exchange System (SDI), and available in the tax portal. For billing purposes: individuals residing in Italy must provide their Tax ID, while Italian companies and organizations must provide their VAT number and SDI Recipient Code or certified email address (PEC). International customers are not required to provide an Italian tax code, and the invoice does not go through the SDI. This information is requested before the order is completed. A courtesy invoice in PDF format is also sent to the customer via email.

7 Right of Withdrawal

Pursuant to Article 59 of the Consumer Code (Legislative Decree No. 206/2005), the right of withdrawal does not apply to the supply of digital content not provided on a tangible medium if performance has begun with the consumer’s express consent.

If you encounter technical issues that prevent you from using the software, we offer free support and, in exceptional cases, will consider a refund on a case-by-case basis.

7.1 Pre-order Products

For products offered for pre-order, payment is due at the time of order to guarantee the User the pre-launch promotional price, while the product (license and related download) is delivered upon release.

The release date indicated on the product page is approximate and subject to change. The actual release date is at the sole discretion of the supplier, who will release the product when it deems that optimal conditions of quality, stability, and functionality have been met. A pre-order purchase does not entitle the User to demand delivery prior to the actual release date set by the supplier.

During the waiting period—that is, from the time the pre-order payment is made until the product is released—Users who change their minds may request a full refund of the amount paid at any time, without any fees.

Since this is digital content, pursuant to Article 59 of the Consumer Code (Legislative Decree 206/2005), once the software has been released and the download has begun with the User’s express consent, the standard right of withdrawal no longer applies.

However, if, after downloading and trying out the software, the User finds that the product does not meet the described specifications, the User may still request a refund within 15 (fifteen) days of the release date, provided the license is returned or uninstalled. Once this period has elapsed, the purchase is considered definitively confirmed.

The supplier reserves the right, at any time, to refund the User and cancel the pre-order if the product is not released.

8 Intellectual Property

All content on the Site, including but not limited to: software, source code, text, graphics, logos, icons, images, videos, and documentation, is the exclusive property of CNC Simulator ITALIA di Benedetto Antonio or their respective owners and is protected by Italian and international intellectual property laws.

Any unauthorized reproduction, distribution, modification, or use of the Content is prohibited without prior written consent.

9 Disclaimer

The software is provided "as is." CNC Simulator ITALIA di Benedetto Antonio does not guarantee that the software is error-free or that it will operate without interruption.

CNC Simulator ITALIA di Benedetto Antonio shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of data, profits, or business opportunities
• Damages resulting from improper use of the software
• Incompatibility with third-party systems or software
• Service interruptions due to force majeure

The maximum liability of CNC Simulator ITALIA di Benedetto Antonio is, in any case, limited to the amount paid by the Customer for the service in question.

9.1 Cessation of Operations

The Lifetime License grants the right to perpetual use of the software in the version provided: in the event of termination, liquidation, bankruptcy, or any other form of cessation of business by CNC Simulator ITALIA di Benedetto Antonio, the software already installed and activated remains fully usable by the Customer, without the need for further activation. The Customer acknowledges and agrees that, in such an event:

• a) the user is not entitled to any refund, whether full or partial, of amounts already paid for the license or for the Maintenance Packages;
• b) all obligations to provide Updates, Technical Support, and maintenance shall cease, including those relating to any Packages that may still be valid;
• c) No indemnification, damages, or compensation of any kind shall be due for the failure to continue providing the service, updates, or support, or for any subsequent incompatibility of the software with future operating systems or hardware.

Legal liability remains in cases of willful misconduct or gross negligence, which cannot be waived pursuant to Article 1229 of the Civil Code.

10 Warranty and Support

We guarantee that the software will function substantially as described in the documentation. In the event of significant defects:

• We are committed to fixing the defect within a reasonable time frame
• We offer free technical support during the active Maintenance Period
• We provide updates that include bug fixes

11 Acceptable Use

The User agrees to:

• Use the Site and Services in accordance with applicable laws
• Do not attempt to access unauthorized systems or data
• Do not interfere with the operation of the Site
• Do not distribute malware, viruses, or malicious code
• Do not use the Services for illegal or fraudulent activities

12 Changes to the Terms

We reserve the right to modify these Terms at any time. Any changes will take effect on the date they are posted on the Site. Your continued use of the Services following the posting of such changes constitutes your acceptance of the new Terms.

13 Governing Law and Jurisdiction

These Terms are governed by Italian law, regardless of the Customer’s country of residence or domicile. This applies to all customers, including those residing in other European Union countries or outside the European Union. The Court of Pordenone shall have exclusive jurisdiction over any dispute.

For consumers residing in Italy, the jurisdiction of the court of the place of residence or domicile remains unaffected, in accordance with the Consumer Code. For consumers residing in other European Union countries, the mandatory consumer protection provisions set forth in the laws of their country of residence apply, where required by law.

14 Final Provisions

The invalidity or unenforceability of any provision shall not render the entire contract void. Invalid provisions shall be replaced by valid provisions that reflect the original intent as closely as possible.

The failure of CNC Simulator ITALIA di Benedetto Antonio to exercise a right does not constitute a waiver of that right.
